Lawyer Felipe Aroca warned that the DIAN is using legal precedents to justify charging VAT for the use of common areas in some properties. However, he clarified that administration fees, as well as fines and reimbursements, are not subject to this tax.
“The DIAN intends to take advantage of a discussion that has been going on for more than 15 years regarding the charging of VAT on parking lots in shopping centers,” Aroca pointed out.
