The Supreme Court of Justice, in Judgment STC14279-2025, with Justice Octavio Tejeiro Duque as the rapporteur, upheld the position of the Superintendency of Companies regarding the deadline and procedural avenue applicable to challenge decisions adopted by the shareholders’ assembly or the board of partners when such decisions contain defects that render them ineffective. With this ruling, the High Court unified criteria that for years had been divided in both case law and judicial practice.
